Welcome to The Genesis Art ("we," "our," or "us"), a product of Genesis Art Tech, Inc. By accessing or using our website (https://thegenesis.art), our application, or purchasing our generative art products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms").

1. Nature of the Service

The Genesis Art provides a platform for creating, visualizing, and purchasing unique digital artwork ("Artwork") generated by our proprietary algorithms. Our service is defined by the following principles:

  • Algorithmic Determinism: Each Artwork is generated using complex mathematical algorithms. The final output is deterministic based on the unique date and other parameters you provide.
  • The "Burn" Mechanic: Prior to finalizing your order ("Claiming"), you are provided with opportunities to preview and "burn" (discard and regenerate) iterations of the Artwork. This ensures you can curate an aesthetic you are satisfied with before purchasing.
  • Finality of Creation: Once an Artwork is "Claimed" and purchased, its specific geometric configuration is locked, registered, and cannot be altered. This action is irreversible.

2. Age Requirement

You must be at least 18 years of age to use our Services. If you are between the ages of 13 and 18, you may only use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

3. Digital Products & Delivery

The Genesis Art sells 100% digital products. No physical goods will be shipped.

  • Immediate Access: Upon successful payment, you will receive access to your secure Personal Vault where you can view and download your purchased Artwork.
  • Cloud Rendering & Processing Times: To ensure infinite resolution and maximum fidelity, premium assets (including 4K Videos, Master PNGs, and Print-Ready PDFs) are rendered on-demand from the cloud. The generation of video assets is computationally intensive; longer processing times are normal and expected for this premium feature.
  • File Formats: Downloadable formats and resolutions vary by the tier of the product you purchase. Please review your selected tier’s features carefully before purchase.

4. Refund Policy (All Sales Final)

Please read this section carefully.

Due to the irrevocable and instantly downloadable nature of our digital products, Genesis Art Tech, Inc. enforces a strict NO REFUND policy for The Genesis Art products.

  • All Sales Are Final: Once you have completed the checkout process and the digital assets have been made available to you, we cannot offer a refund, exchange, or cancellation.
  • Why No Refunds? You are provided with a preview and a "Burn/Reroll" feature before purchase, allowing you to ensure you are satisfied with the visual aesthetics of the generated art. By proceeding to payment, you acknowledge your satisfaction with the previewed design.
  • Exceptions: Refunds will only be considered at our sole discretion in the event of a verifiable technical failure where the digital product was not delivered or the file is corrupted and unrecoverable by our team. In such cases, you must contact contact@thegenesis.art within 7 days of purchase for assistance.

5. Payments & Payment Processors

Genesis Art Tech, Inc. uses third-party payment processors to handle order processing, tax collection, and payment fulfillment. Your transaction will be processed by one of our authorized payment partners:

  • Dodo Payments

By purchasing our digital goods, you acknowledge that the payment processor acts as the payment handler for the transaction. As such, the charge on your bank statement may appear as "Dodo Payments," and not "The Genesis Art" or "Genesis Art Tech, Inc." All refunds and chargebacks are subject to the specific payment processor's acceptable use policies in addition to our own refund policy.

6. Intellectual Property Rights

6.1 Our Intellectual Property

All aspects of the Services are the exclusive property of Genesis Art Tech, Inc. "The Genesis IP" includes, but is not limited to, the Genesis Algorithm, the Endless Algorithm, all other art generation algorithms, their underlying mathematical principles, the ArtworkDNA data structure, all source code, software, text, graphics, logos, and the overall look and feel of the Services. You agree not to copy, modify, or create derivative works from The Genesis IP.

You are strictly prohibited from using any content, data, images, videos, or other assets generated by or scraped from our Services to train, fine-tune, or otherwise develop any artificial intelligence or machine learning models. You shall not attempt to, nor assist others to, reverse-engineer, decompile, disassemble, or otherwise derive the source code or underlying ideas or algorithms of any part of The Genesis IP.

6.2 Your License to Purchased Artwork

Upon successful purchase, you are granted a non-exclusive, perpetual, worldwide, royalty-free license to display, print, and use the associated digital files (including but not limited to SVG, PNG, PDF, and video files) for personal, non-commercial purposes only (e.g., home decor, personal social media profiles, personal gifts).

This license expressly prohibits all commercial uses. You may not resell, redistribute, or use the Artwork for any commercial gain (e.g., selling prints, merchandise, or stock content). This license also strictly prohibits the minting of any Artwork into a Non-Fungible Token (NFT) or any other form of blockchain-based asset.

7. User Conduct

You agree not to use the Services to:

  • Generate content that is unlawful, offensive, hateful, or violates the rights of others.
  • Violate any applicable laws or regulations.
  • Use the "Personal Note" feature in gifting to send spam, harassment, or illegal content.

8. Termination

We reserve the right to terminate or suspend your access to the Services, including your personal artwork vault, immediately and without prior notice, if you violate any of these Terms.

9. Disclaimers

  • "As Is" Basis: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
  • Artistic Subjectivity: Art is subjective. While we provide the "Burn" tool for curation, we do not warrant that the final algorithmic output will meet your specific artistic taste beyond what was previewed.
  • Color Variations: Printed colors may vary slightly from what you see on your screen due to differences in monitor calibration, screen technologies, and printer profiles.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GENESIS ART TECH, INC., ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE TOTAL AMOUNT YOU PAID US FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to defend, indemnify, and hold harmless Genesis Art Tech, Inc. and its affiliates from and against any claims, damages, costs, liabilities, and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or related to your use of the Services or your breach of any of these Terms.

12. Governing Law & Dispute Resolution

a) Governing Law

These Terms and any disputes arising from them shall be governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles.

b) Amicable Resolution

We are committed to customer satisfaction. If you have an issue or dispute, you agree to first contact our support team at contact@thegenesis.art to seek an amicable resolution before taking further action.

c) Arbitration for US Users

If you are a user based in the United States, you agree that any dispute that cannot be resolved amicably will be settled by binding arbitration administered by a recognized US-based arbitration service (e.g., the American Arbitration Association) under its consumer arbitration rules. The arbitration will be conducted in English, and may be done online or via teleconference.

d) Consumer Rights for EU/UK Users

If you are a consumer based in the European Union or the United Kingdom, these Terms do not limit your mandatory statutory rights. You are entitled to bring a claim to enforce your consumer protection rights in connection with these Terms in the courts of your country of residence.

e) General

For all other users, any dispute not resolved amicably shall be resolved by binding arbitration in English, conducted online via an internationally recognized arbitration platform.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the revised Terms on this page with an updated "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
